STANDARD TERMS AND CONDITIONS OF SALE


These Terms and Conditions ("Terms") govern all purchases, services, and interactions with Sound Decision Ltd., a Bermuda-based electronics retailer and custom installation service provider. By placing an order or using our services, you agree to these Terms.

1. General Terms

1.1. These Terms apply to all sales and services provided by Sound Decision Ltd., including in-store purchases, online orders, and custom installations.

1.2. We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting.

2. Orders & Payments

2.1. Order Acceptance: Orders are subject to availability and approval. We reserve the right to refuse any order.

2.2. Payment Terms:

  • Invoices are due upon completion of the job.
  • Payments can be made by check payable to Sound Decision Ltd., by direct deposit to our HSBC account (#011-026069-002), or via credit card.
  • Credit card payments over $15,000.00 will incur a 3.75% service charge.
  • Estimates: A valid credit card must be provided for all jobs in case of non-payment after 30 days.

2.3. Late Payments & Collection:

  • Invoices not paid within 30 days will incur a 1.5% service charge per month.
  • If unpaid balances are sent to Attorneys or Collection Agents, the customer will be responsible for all legal/collection fees incurred.

2.4. Price Changes: Prices are subject to change without notice. Orders placed before a price change will retain the agreed-upon price.

3. Shipping & Delivery

3.1. Local Delivery Only: Orders are delivered within Bermuda. Shipping fees may apply.

3.2. Delivery Timelines: Estimated delivery times are provided at checkout but may be affected by supplier delays.

3.3. Risk of Loss: Title and risk of loss pass to the customer upon delivery. We are not liable for lost or stolen goods after delivery.

4. Returns & Exchanges

4.1. Retail Sales Counter Purchases:

  • All products are covered under a six-month Parts and Labor warranty unless otherwise indicated at the time of purchase. .
  • Only unopened accessories and portable audio products are eligible for return.
  • Returns must be made within 5 days from the original purchase date and are subject to a 10% restocking fee.
  • Opened items may be returned at management's discretion and will be subject to a 25% restocking fee.
  • Refunds will be processed using the original method of payment.

4.2. Installed Products:

  • All products and installations supplied and installed by Sound Decision Ltd. come with a one-year Parts and Labor warranty and are serviced by our own technicians.
  • Installation and labor fees are non-refundable.

5. Warranty & Repairs

5.1. Manufacturer Warranty: Products sold by Sound Decision Ltd. are covered under their respective manufacturer warranties.

5.2. Sound Decision Ltd. Warranty:

  • Installed products come with a one-year Parts and Labor warranty.
  • Retail sales products come with a six-month Parts and Labor warranty unless otherwise indicated at the time of purchase. .

5.3. Exclusions:

  • Damage caused by misuse, power surges, unauthorized repairs, or natural disasters is not covered.
  • Warranties do not cover software, data loss, or third-party services.

5.4. Service Fees:

  • Out-of-warranty repairs are subject to service fees.
  • Additional installation service calls due to customer-requested modifications may incur charges.

6. Custom Installations & Services

6.1. Scope of Work: Custom installations are scheduled after a consultation. Any additional work outside the initial quote will be charged separately.

6.2. Site Requirements: The customer is responsible for ensuring the installation site is ready (e.g., access to power, internet, mounting surfaces).

6.3. Delays: Installation delays due to site conditions or third-party involvement are not our responsibility.

7. Limitation of Liability

7.1. Sound Decision Ltd. is not liable for:

  • Indirect, incidental, or consequential damages arising from product use, installations, or service delays.
  • Data loss, software issues, or network disruptions caused by installations.
  • Any third-party service provider failures (e.g., internet, cable, satellite providers).

7.2. Our total liability is limited to the total amount paid for the product or service in question.

8. Privacy & Data Protection

8.1. We do not share or sell personal information to third parties.

9. Governing Law & Dispute Resolution

9.1. These Terms are governed by the laws of Bermuda.

9.2. Any disputes shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes will be subject to arbitration in Bermuda.
